He was first held at Steklotar, one of the most notorious torture and detention facilities in occupied Kherson, then taken to an unknown location. For a year and a half, Seryozhenko's family didn't know where he was or what was happening to him. It wasn't until February 2024 that he was officially charged with aiding an act of international terrorism and possessing and transporting an explosive device. According to Memorial, as of March 2026, he is being held in Pre-trial Detention Center No. 1 of the Federal Penitentiary Service of Russia for the Chechen Republic.

According to the FSB, Seryozhenko participated in an assassination attempt on Yevhen Sobolev, the head of the Kherson Oblast Security Service appointed by the Russian occupation authorities. Sobolev's car exploded on June 18, 2022. The security officer survived. Seryozhenko's case is based solely on his confession, which he partially retracted in court. He was likely forced to incriminate himself under threats and torture. The case was submitted to the Southern District Military Court on June 5, 2024. Seryozhenko was charged under Part 3 of Article 222.1 of the Russian Criminal Code and Part 2 of Article 205 of the Russian Criminal Code. On August 6, 2024, Judge Denis Aleksandrovich Galkin returned the case for further investigation with the wording that "the factual circumstances indicate the presence of grounds for classifying the actions as a more serious crime." On November 14, 2024, the charge was reclassified to Part 1 of Article 222.1. 361 of the Criminal Code of the Russian Federation and paragraph 3 of Art. 222.1 of the Criminal Code of the Russian Federation.

On May 13, 2025, the Southern District Military Court in Rostov-on-Don sentenced Andrei Serezhenko to 17 years in prison, with the first two years to be served in a maximum-security penal colony, and a fine of 300,000 rubles. He was found guilty of committing an act of international terrorism (Part 1 of Article 361).
